The California Air Resources Board (CARB) announced it plans to repeal the High Priority Fleet and Drayage Fleet provisions under the Advanced Clean Fleets (ACF) regulation with a formal proposal due by October 31, 2025, and final action required by August 31, 2026. The repeal is due to legal challenges from various states, spearheaded by Nevada’s attorney general, and industry groups, including the California Trucking Association, concerned about the regulations’ impact on commerce.
The ACF Rule
Under the ACF’s rule, high-priority fleets – those over $50 million in revenue or with 50+ vehicles –had to phase in zero-emissions (ZEVs) through a “Model Year Schedule” or “ZEV Milestones Option” beginning in 2024. Drayage fleets were required to register new trucks as ZEVs starting January 1, 2024, with all drayage trucks having to be ZEVs by 2035. The drayage requirements were to be the first rules to hit California’s trucking sector, requiring any new drayage trucks to be registered with the state after Jan. 1, 2024, to be zero-emission vehicles. But California, in late 2023, stated that it would not enforce that mandate while various lawsuits were underway.
California’s Agreement in Lawsuit
According to court documents, the agreement between the state and the plaintiffs in the lawsuit requires CARB staff to present a proposal to the board to repeal the high-priority fleets and drayage requirements of ACF. The plaintiffs agreed to dismiss their case after the repeal becomes effective under state law.
In addition to Nebraska’s AG, the attorneys general of 15 other states joined as plaintiffs: Alabama, Arkansas, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Missouri, Montana, Oklahoma, South Carolina, Utah, West Virginia, and Wyoming. The Nebraska Trucking Association and the Arizona State Legislature were also plaintiffs.
