Compliance Gap Overview

Mismatched data across DMV, CHP, and FMCSA systems is one of the leading reasons for suspensions, even when insurance is current. This overview outlines how those data points align across agencies before they affect your authority.

Data Points Resulting Impact on Authority
Legal Entity Alignment Highlights name or FEIN mismatches across DMV, CHP, and
FMCSA
Inspection & Safety Records Identifies prior roadside data and BIT history used by
carrier underwriters
Filing Synchronization Aligns Workers’ Comp, liability, and UIIA records to reduce
gap suspensions

Critical California Compliance Questions

  • Why is my MCP suspended even though my insurance is active?

In many cases it is not about lapsed coverage. DMV systems often flag a missing renewal application or mismatches between the name, or address, and details on your MCP 65 M certificate and your official records. Fixing these issues usually restores the permit.

  • Can I use a Form E for the California DMV?

No. California requires the state specific MC 65 M certificate for intrastate operations and MCP compliance. Federal filings like BMC 91X do not meet this requirement.

  • Does a standard General Liability policy protect me from PAGA
    or AB5 claims?

No. Labor related claims under California rules are typically excluded. EPLI coverage written for these exposures is usually more appropriate.
